MyCustomLogo.com is owned by GeekFace LLC. MyCustomLogo (hereafter described as "MCL") provides the following terms and conditions for users of this site.

By signing up as a client of MCL or using the MyCustomLogo.com site, you agree to be legally bound by these conditions. Please read these terms carefully. MyCustomLogo may change these terms at anytime by updating this posting. You should visit this page periodically to review these conditions, as they are binding to you.

You acknowledge and agree that MyCustomLogo.com shall have the right (but not the obligation) in its sole discretion, to pre-screen, refuse or remove any project and/or user provided content that violates these Terms and Conditions or is otherwise objectionable, including, without limitation, projects or content that is illegal, obscene, indecent, defamatory, incites religious, racial or ethnic hatred, or violates the rights of others. Activity that is brought to our attention which appears in our sole judgment to violate the law will be brought to the attention of the proper authorities. You acknowledge, consent and agree that MyCustomLogo.com may access, preserve, and disclose your account information and content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Terms and Conditions; (c) respond to claims that any content violates the rights of third-parties; (d) respond to your requests for customer service; or (e) protect the rights, property, or personal safety of MyCustomLogo.com, its users and the public.

MyCustomLogo strives to be a family friendly site, and as such, retains the right to refuse and refund, at it's discretion, any projects or content that is a. Explicitly Adult in nature, or deemed inappropriate by MCL
b. illegal, obscene, indecent, defamatory, incites religious, racial or ethnic hatred, or violates the rights of other

LOGO DESIGN RESTRICTIONS/GUIDELINES:

Regarding custom logo design packages: Ownership of the final artwork or design become the property of the client, having unlimited, indefinite, and royalty-free use of artwork upon approval of the final draft. MCL retains rights to display the artwork in portfolio and advertising materials. All concepts or any preliminary materials which are not selected by the client or are not included in the final delivery, remain the full property of MCL.

The number of concepts that are included in the package that you purchase are the the number of concepts that you will receive. MCL does not guarantee you additional concepts, beyond the revisions or redraws included in the design package that you purchased.

Your project manager handles all revisions to your chosen logo concept. A revision is: a change to color, text, or the positioning of different elements of the logo. A revision is not redrawing any part of the logo or creating a new logo.

Financial Information :

MCL uses PayPal as our payment processor. We do not actually collect personal financial information. Please go to the PayPal.com site to read their terms and conditions and privacy policy.

Personal Information:

The details of your order may be disclosed to third parties, to facilitate filling your order.

MCL does NOT provide the following information to any third party: your name, phone number, address or email address. MCL retains this information so that a representative from MCL can contact you if the need arises.

Client Responsibilty - Final Artwork:

Subject to your compliance with these Terms and Conditions, you shall own the approved logo concept provided to you by MCL (the "Final Product"). You shall not, however, own any materials, media or other content generated during any revision cycles leading up to the Final Product, and MCL expressly reserves all right, title and interest in and to the same. You acknowledge and hereby grant to MCL a royalty-free, irrevocable exclusive worldwide right to use original and revised logo concepts provided to you, with the exception of the "final product", in any way whatsoever. MCL retains the rights to all artwork concepts and other content not selected by you. You acknowledge that your ownership rights under these Terms and Conditions are limited to the Final Product, and that no trademarks or service marks in or to any Final Product are being conveyed under these Terms and Conditions. You hereby acknowledge that MCL shall have no obligation or duty to perform trademark, service mark or copyright searches or inquiries, or the like, in order to validate the propriety or legality of the Final Product. Accordingly, you are encouraged to perform your own independent searches with regard to the Final Product. Furthermore, you acknowledge that MCL shall have no responsibility or obligation of any kind to assist you in seeking state or federal intellectual property protection (i.e., without limitation, trademark or copyright registration) for the Final Product, nor shall MCL be responsible for otherwise assisting you in any way in your attempt to perfect your rights in or to the Final Product. You also agree that MCL is in no way responsible for assuring the originality of any work delivered, and that it is your full responsibilty to research all artwork received by you before using it in any way. MCL is in no way responsible for any legal difficulty of any kind incurred by using any graphic design service purchased from MCL.

No refunds will be issued once the logo has entered the design stage. No redraws are allowed unless specified in the package details. MyCustomLogo does not guarantee or promise a refund in any way whatsoever. At times a refund MAY be issued, fully at the discretion of MCL staff, this is not a promise or a guarantee. Should you receive a refund, you agree that your acceptance of the refund shall constitute your sole and exclusive remedy with respect to related Responses. Additionally, you acknowledge that you will have no right (express or implied) to use any Response or other work product, content, or media, nor will you have any ownership interest in or to the same.

Chargebacks and PayPal Disputes:

MCL's policy on PayPal disputes is as follows: all PayPal disputes get escalated to PayPal management and the order concerned is immediately terminated. You will not be allowed to select any of the concepts that you have already received

Any chargeback issues are turned over to an external collection agency and may be pursued to the full extent of the law.

Project Duration:

You agree to provide timely responses to any status notifications that MyCustomLogo sends to you. You shall have 30 days to respond to each Response sent to you. If after 30 days you have failed to respond, will assume that your project is complete and the project shall be deemed completed. At such time, MyCustomLogo will have no further obligation to you, and all monies paid prior will not be refunded. Notwithstanding the foregoing, MyCustomLogo reserves the right, in its sole discretion, to terminate your access to all or a portion of the Service, at any time, with or without notice. In the event of such termination, MyCustomLogo will determine, in its sole discretion, whether you are entitled to any refund.
